About these terms

These terms of service ("Terms") govern your use of dyvetech.com (the "Site"), operated by Dyve Technology, LLC ("Dyve," "we," "us"), an Illinois limited liability company based in Naperville, Illinois. By accessing or using the Site, you agree to be bound by these Terms. If you don't agree, please don't use the Site.

What this site is

This Site is a marketing and information website for Dyve Technology, LLC. It describes our services, publishes our pricing for select offerings, and provides a way to contact us. Nothing on the Site constitutes a binding offer to provide services, a guarantee of availability, or professional advice that you should rely on without talking to us first.

Engagements are governed by separate agreements

If you become a client, the work we do together is governed by a separate written engagement agreement (a Statement of Work, Master Services Agreement, Consulting Agreement, or similar). Pricing, scope, deliverables, timelines, and obligations in any such agreement control over anything on this Site. In the event of a conflict between these Terms and a signed engagement agreement, the engagement agreement controls for matters covered by that agreement.

Use of the Site

• You may view, read, and share the content on the Site for personal or business purposes.
• You may not copy, reproduce, republish, or redistribute site copy, design, or visual assets without our written permission.
• You may not use the Site to transmit anything unlawful, harmful, threatening, defamatory, obscene, or otherwise objectionable.

• You may not attempt to interfere with, compromise, or probe the Site's security.

The Site and its content are provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express, implied, or statutory. We do our best to keep information accurate and up to date, but we do not warrant that the Site will be error-free, uninterrupted, secure, or free of viruses or other harmful components. Information on the Site is for general informational purposes only and is not a substitute for professional advice tailored to your specific situation.

Limitation of liability

To the fullest extent permitted by applicable law, Dyve Technology, LLC, its members, employees, and agents will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages (including loss of profits, data, or goodwill) arising from or related to your use of the Site, even if advised of the possibility of such damages. Our total liability to you for all claims arising from or related to the Site is limited to one hundred U.S. dollars ($100). Governing law and jurisdiction

These Terms are governed by the laws of the State of Illinois, without regard to its conflict of laws principles. Any disputes arising from these Terms or your use of the Site will be resolved exclusively in the state or federal courts located in DuPage County, Illinois, and you consent to the personal jurisdiction of those courts.

Severability and entire agreement

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect. These Terms, together with our Privacy Policy and any separate written engagement agreement covering client work, constitute the entire agreement between you and Dyve Technology, LLC regarding your use of this Site.

Changes to these terms

We may update these Terms from time to time. When we do, we'll update the "Last updated" date at the top of this page. Material changes will be flagged at the top for at least 30 days. Continued use of the Site after a change means you accept the updated Terms. If you don't agree with an update, please stop using the Site.
